Let 'Em Go
The jury in the Dena Schlosser capital murder trial (the baby arm case) begin deliberations again this (Saturday) morning.
It's the third day of deliberations. They have already told the judge on Thursday that they were hopelessly deadlocked, and "no one is going to change their decision," but the judge ordered them to continue deliberating.
It's time to let them go. If there is a verdict now, there is to great of a risk that one or more of the jurors has simply given up and wants to go home.
Perhaps This Is Why The War Isn't Going Real Well

The government just forgot to add, "And don't shoot a video and post it on the web!". Oh, no.

It Wasn't Because He Was Guilty As Sin
The Barbee guy was convicted today of capital murder for killing his ex-girlfriend and seven year old child. This caught my eye from the Star-Telegram:
Shortly after [the judge] called a lunch break, a woman who identified herself as Jodi Fratta said she was a spokeswoman for Barbee’s family and spoke to reporters.
Fratta said the family blames the guilty verdict on the unwillingness of Barbee’s attorneys to listen to their ideas.
“The family still loves him and believes in him,” said Fratta, adding that his family believes that Barbee is innocent. “The state of Texas didn’t convict Stephen Barbee of capital murder, his own attorneys did.”
The "A" Word
South Dakota just passed law, awaiting the governor's signature, that outlaws virtually all abortions.
It is clearly unconstitutional based upon the 1973 decision of Roe v. Wade. Uh....wait....I don't think Alito and Roberts were on the court back then, were they?
The battle has begun.
(But if the Supreme Court overturns Wade, it doesn't mean that abortion automatically becomes illegal across the nation. It will be up to each State legislature to make that decision. With this caveat: If there are any abortion laws still on the books that were never repealed. they would automatically spring back into life. I'm trying to determine if Texas ever repealed its abortion law - something I serously doubt).
Edit: Texas no longer has an abortion law because it has been "repealed by implication" (a concept that made my head hurt). See McCorvey v. Hill, No. 03-10711 (5th Cir. 2004)

That's the name of a new NBC series that features "young and aggressive" new prosecutors in New York City. Spare me.
So I'm on my comfy couch rolling my eyes when I decide to google it to find out more.
What I found surprised me: The premiere episode is available as a free video download at I-Tunes before it debuts on TV.

He Wants A "Do Over"
The crazy trial of Stephen Barbee "allegedly" killing pregnant Lisa Underwood and her young son is going on in Tarrant County.
This was a incident in north Tarrant County. Barbee had recently married but had had an affair with Underwood. She ended up pregnant and Barbee allegedly killed her because she threatened to destroy his marriage.
He kills Underwood and (this is the hard part to explain) her seven year old son.
There was a bombshell yesterday: The autopsy revealed that the unborn child was not product of Barbee's uncontrolled sexual urges. She was screwing around with someone else.
Doesn't matter. This guy is gonna die.

Uh Oh
I'm a foreign affairs idiot but a story today out of Iraq seems huge.
There are Shiites and Sunnis in Iraq. I'm not exactly sure what the difference is but is seems like they can be compared to The Union and the Confederacy. Well, today "the golden dome" of one of the holiest Shiite shrines was blown up. (Great before and after pic here.) And the Shiites blame the Sunnis. That led to massive retaliation.
The use of the term "Civil War" in Iraq was all over the news.
Mark it on your calenders. Today might have been Iraq's attack of Fort Sumter.
Oh, The Horror
The U.S. Hockey team was eliminated from the Olympics today after a brief and embarrassing stay.
But Dallas Star Mike Modano had an excuse:
"You'd think USA Hockey would be a well-oiled machine, but it's not," he said. "Basically we were on our own for hotels, tickets, flights, stuff like that. Normally we wouldn't have to worry about stuff like that."

Rich AND Funny
Today, eight workers at a Nebraska meat processing plant have claimed the record $365 million Powerball jackpot. The seven men and one woman were introduced by Gov. Dave Heineman in Lincoln, Nebraska. When one of the workers was asked if he was still working at the plant, he replied: "I've been retired for about four days."
By the way, after receiving the lump sum, taking out taxes and dividing by eight, each person got about $15.5 million.

Baby Death Trial
The trial of the woman that killed her child by cutting off her the baby's arms is wrapping up.
The unspoken word is that the prosecution fully expects the jury to find the woman not guilty by reason of insanity. They simply refused to agree to that resolution and wanted a jury to make that decision instead.

Bush Has Lost It
Just as the country is getting up in arms over the United Arab Emirates / U.S. Ports controversy (see blog below), Bush goes on a major offensive today saying that he will veto any legislation that tries to derail the deal.
He can piss off Democrats and no one cares. But this time he's thumbing his nose at the right wing (which has been very vocal in opposition of this deal).
And to think Bush has not issued one single veto while in office. (Really). And he wants to do so now to benefit the United Arab Emirates?

I heard a radio commercial this morning for former district judge Vic Cunningham who is now running for DA in Dallas County.
Cunningham, as a judge, presided over the Texas 7 capital murder trials, and he isn't bashful about reminding us of this.
But the ad made me throw up when it said, "Vic Cunningham looked each of the Texas 7 in the eye when he sentenced them to DEATH!"
Sheesh. It was a jury that sentenced them to death. He was just following the jury's orders.

Ok, Defend This
There is a crazy story that is taking the nation by storm (and kudos to a faithful reader for emailing this story six days ago although I couldn't believe it). It will only get worse. What you need to know: -- For some crazy reason, our federal government bids out contracts to "run" the coastal ports in New York, New Jersey, Baltimore, New Orleans, Miami and Philadelphia. --(I've yet to find the definition of "run" but apparently the control is expansive). --For the last several years, the company winning the bid to control those ports has been a British company called Peninsular & Oriental Steam Navigation Co. --We like Britain. They are our friends. Tony Blair likes W. They support our War On Terror. --Last week, a company owned by the Persian Gulf country,the United Arab Emirates, bought the British company. --That means the United Arab Emirates is going to be in charge of major U.S. Ports. --The United Arab Emirates has "Arab" in its name. --Ok, the United Arab Emirates has ties to 9/11 --The Bush Administration, and I am not making this up, is in favor of this deal. --The current director of Homeland Security, Michael Chertoff , said this weekend that, "We make sure there are assurances in place, in general, sufficient to satisfy us that the deal is appropriate from a national security standpoint." --Exactly how was this done? Can't tell you, "it's classified". (Sound familiar?) --Even Republicans on Capital Hill are raising hell about this deal. --The Bush Administration is so scared of terrorism that they have to monitor your phone calls. --The Bush Administration isn't worried about the United Arab Emirates running our ports. --I'm confused.
