(1) The defense has no right to present any evidence to a grand jury. The DA can prevent it.
(2) The premise of the letter is wrong. The requirement of at least nine members of a grand jury choosing to indict a person is mandated by state law. It is not the "policy" of the DA.
But that's OK, this guy was just the forman of a Tarrant County grand jury responsible for indicting thousands of individuals.
